JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-07-2019 This application, for grant of anticipatory bail, arises out of Jurawanpur P.S. Case No. 57 of 2017, disclosing offences under Sections 341, 323, 324, 307, 379, 504 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Prosecution case is that petitioners came on the mobile repair shop of the informant and petitioner no. 1 fired, on the informant, which hit his left hand and when the uncle of informant came to save him, petitioner no. 2 fired at him causing injury in his hand.

Submission of learned counsel for the petitioners is that so far petitioner no. 3 is concerned no allegation of firing has been levelled against him and though there is allegation against petitioner nos. 1 and 2 of firing on the informant and his uncle but

It has also been submitted that a case has also been lodged by the informant's side against the father of informant and due to which, the present false case has been lodged.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, so far petitioner nos. 1 and 2 are concerned, I am not inclined to grant them, the privilege of anticipatory bail.

So far petitioner no. 3 is concerned, in the event of his arrest or surrender before the court below within six weeks from the date of receipt / production of a copy of this order, is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM -VIII, Vaishali, Hajipur, in connection with Jurawanpur P.S. Case No. 57 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
