The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 448, 384, 506 of the Indian Penal Code.

The accusation is of demanding extortion of rupees five lacs and in the eventualities of non-fulfillment, life threatening was also given.

It is submitted by learned counsel for the petitioner that even if assuming the accusation, at best, the offence under section 385 IPC is made out. Since the petitioner was inimical terms with the informant, hence, maliciously, the accusation has been levelled and investigation has already concluded. The aforesaid facts constitute ground for

Patna High Court Cr.Misc. No.54342 of 2015 (2) dt.01-12-2015 2/2 consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Benipatti P.S. Case No.111 of 2013, pending before the learned Judicial Magistrate, 1st Class, Madhubani. With the above observation, this application is, accordingly, disposed off.
