JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-12-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,323,325,435 and 504 of the Indian Penal Code and section 27 of the Arms Act.

The prosecution case is that the accused persons came variously armed, abused and assaulted the informant causing injury and lit the hut of husk on fire.

It is submitted by the learned counsel for the petitioners that in the background of land dispute the accusation has been

Patna High Court Cr.Misc. No.54693 of 2015 (2) dt.03-12-2015 2/2 levelled. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. There is no injury report on record. Statement to that effect has been made in paragraph 12 of the petition which reads as follows: "That there is no injury on the record."

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Lakhisarai, in connection with Pipariya P.S. Case No. 41 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
