JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 406, 504, 506, 379, 34 of the Indian Penal Code and section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
It is alleged that the generator set of the informant was given to the petitioner on rent but neither it was returned nor the rent for the same was paid when demand being raised, the informant was abused by calling caste name and assaulted. It is submitted by learned counsel for the petitioner that for the occurrence of 2011, the FIR was registered in 2014 and there is nothing on record to suggest that actually the generator set was given to the petitioner on rent.

No.55292 of 2015 (2) dt.07-12-2015 2/2 Considering the delayed nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class Jhanjharpur, Madhubani in connection with Bheja P.S. Case No.66 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
