This is a petition for grant of anticipatory bail for offences under Sections 406, 409, 420 and 34 of the Indian Penal Code.

The petitioner was Assistant working at the referred Paddy Purchase Center. Co-accused, Arun Kumar Sharma, was In-Charge of the Center. Allegation is that entire paddy was not sent for milling nor the rice was produced. Certificate proceeding is already going on.

Submission of the petitioner is that the petitioner was simply an Assistant and has no role to take any decision in the matter.

Considering the aforesaid fact specially the fact that the petitioner is a female, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Giriyak P.S. Case No.

Patna High Court Cr.Misc. No.55431 of 2016 (3) dt.17-02-2017 2/2 197 of 2016 to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
