====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 22-04-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in CI-31 of 2019/C.I.S. No. 31 of 2019, instituted for the offence under Section(s) 30(a) of Bihar Prohibition & Excise Act, 2016. It is alleged in the written report that 41.490 litres of foreign liquor kept beneath the seat in two bags, has been recovered from bus coming from Siliguri to Purnea. Counsel for the petitioner submits that petitioner has no concern with the aforesaid liquor. He was merely passenger in the Bus.

Petitioner is in custody since 15.3.2019 having clean antecedent.

Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Purnea, in connection with CI-31 of 2019/C.I.S. No. 31 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioner.
