The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 366A and 504/34 of the Indian Penal Code.
The prosecution case is that the informant's daughter went to school on 18.06.2015 at 9.00 A.M. but after that she went traceless. Subsequently, the informant came to know that the petitioner abducted his daughter and took her on a motorcycle. On 19.06.2015 when the informant went to the house of the petitioner then he found the petitioner missing. It is submitted by learned counsel for the petitioner that the victim was in love with the petitioner. For the occurrence of 18.06.2015 the FIR was registered on 07.09.2015.
Patna High Court Cr.Misc. No.46150 of 2016 (2) dt.22-10-2016 2/2 In 164 Cr.P.C. statement the victim has got her age recorded as 20 years when the court has assessed her age as 16-17 years where she has stated that she of own married with the petitioner in a temple. As per the medical report she was found aged 17-18 years.
Considering the 164 Cr.P.C. statement of the victim, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate IV, Nawada in connection with Sirdala P.S. Case No. 182 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
