This is an application for grant of anticipatory bail in connection with Makhdumpur (Tehta) P.S. Case No. 95 of 2017 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 380, 384 and 504 of the Indian Penal Code.
The allegation in the present case is regarding several persons having gathered near the jewellery shop of the informant and some of the co-accused persons having assaulted the informant while the petitioner herein is alleged to have taken away ornaments worth Rs. 1,50,000/- and cash of Rs. 23,000/- from the shop of the informant.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case,
Patna High Court Cr.Misc. No.10306 of 2018 (3) dt.28-02-2018 2/2 however, he submits that the petitioner is ready to deposit a sum of Rs. One lakh with the Nazarat of the concerned court. Having regard to the facts and circumstances of the case, I am of the considered view that since the petitioner is ready to deposit a sum of Rs. 1,00,000/- (one lakh) with the Nazarat of the concerned court, it would be appropriate to admit the petitioner to the privilege of anticipatory bail.
Accordingly, let the petitioner above named deposit a sum of Rs. 1,00,000/- (rupees one lakh) with the Nazarat of the concerned court within a period of four weeks from today and surrender within the same time frame, whereupon the petitioner herein would be admitted to the privilege of anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Makhdumpur (Tehta) P.S. Case No. 95 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
