The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 393 of the Indian Penal Code.

Four persons were attempting to robe the informant. However, the villagers apprehended three of them and they disclosed the name of petitioner as co-culprit who fled away. Submission of the petitioner is that the petitioner has got no criminal antecedent and he is ready to fully co-operate with the investigation and even to appear for TIP, if required by the police. He is not going to tamper with the evidence and only material against the petitioner is the confessional statement of the co-accused.

No.51050 of 2016 (3) dt.10-02-2017 2/2 Considering the aforesaid facts as well as subject to undertaking of the petitioner as aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Araria/Successor Court in connection with Jokihat Police Station Case No. 239 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
