The petitioner apprehends his arrest in connection with Halsi P.S. Case No. 18 of 2017 registered under Sections 147, 148, 149, 341, 323, 504, 307 of the I.P.C. and 27 of the Arms Act pending in the Court of C.J.M., Lakhisarai. Submission is that petitioner is quite innocent and has falsely been implicated in this case. Nothing has been recovered from the possession of the petitioner. There is no repetition of firing.
Learned A.P.P. appearing on behalf of the petitioner opposed the prayer of the petitioner by contending that there is direct allegation of firing against the petitioner with intention to
Patna High Court Cr.Misc. No.45175 of 2017 (2) dt.19-09-2017 2/2 kill him.
Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, the application is rejected.
