The petitioner seeks bail in Hathidah P.S. Case No.82 of 2018, corresponding to Special Case No.11214 of 2018 registered under Section 30(a) of Bihar Prohibition and Excise Act.

The informant on the basis of secret information intercepted a pick up van bearing registration No.BR-09H-3441 and recovered 1074.600 litres of foreign liquor. The driver was apprehended. The driver disclosed his name as Vibhakar Rai. The driver disclosed that petitioner and Deepak Kumar loaded the liquor on a pick up van for sending the consignment to Bhola Kumar of Lohia Nagar, Begusarai. The driver also provided mobile numbers of the petitioner and Deepak Kumar.

No.25243 of 2020(2) dt.28-09-2020 2/2 The learned counsel for the petitioner submits that prayer for bail of the petitioner was earlier rejected by a coordinate bench of this Court vide order dated 27.02.2020 with observation that the petitioner may renew his prayer for bail after framing of charge. Co-accused Deepak Kumar has already been granted bail vide order dated 26.02.2019 by another coordinate Bench vide order passed in Cr. Misc. No.11855 of 2019. The charge has already been framed. Vibhakar Rai, the driver of the vehicle has also been enlarged on bail. Taking into consideration the facts aforesaid, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Hathidah P.S.
