The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code section 4 of The Protection of Children from Sexual Offences Act, 2012. The prosecution case is that the minor daughter of the informant was abducted by Kamlesh Das with the assistance of the petitioners and others. It is submitted by learned counsel for the petitioners that the thrust of accusation is against Kamlesh Das

Patna High Court Cr.Misc. No.55600 of 2015 (2) dt.08-12-2015 2/2 and the petitioners are roped in since they are mother, brother and co-villager of Kamlesh Das. The victim was found aged about 17 years and the father of Kamlesh Das has been granted bail vide Cr. Misc. No. 29195 of 2015 by a co-ordinate Bench of this Court.

A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Madhubani in connection with Babubarhi P.S. Case No. 177 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
