.... Opposite Party/s ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 13-01-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 341, 323, 354, 504, 506 and 420 of the Indian Penal Code and 3 (i) (x) of the Scheduled Caste and Scheduled Tribes ( Prevention of Atrocities) Act. Allegation against the petitioner is that he demanded Rs.10,000/- from the informant for getting them allotted permanent Indira Awas. Informant paid Rs.4,000/- but did not get Indira Awas. On demand of return of the money, petitioner threatened and abused her by taking caste name. It is submitted on behalf of the petitioner that he has got no criminal antecedent. He has been made accused due to mistake of fact.

The allegation made by the informant is that she had given Rs.4,000/- to the petitioner along with two other persons for allotment of Indira Awas. The said allegation is denied by the petitioner. It is further submitted that petitioner is ready to deposit an amount of Rs.12,000/- in the court below which shall be released in favour of the informant.

On behalf of the State, it is submitted that petitioner is

Considering the aforesaid facts and circumstances, it is directed that petitioner shall deposit Rs.12,000/- in the court below which shall be released in favour of the informant. Let the above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Jamui, in connection with Jamui S.C. & S.T. Case no. 48 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
