This application, for grant of anticipatory bail, arises out of Makhdumpur Police Station Case No. 184 of 2015, disclosing offences under Sections 47(a)(c)(e)/50/54 of the Bihar Excise Act, 2016.
From the First Information Report, it transpires that from the petitioner's room, considerable amount of foreign liquor was recovered.
It is alleged that he, along with others is involved in illegal trade of foreign liquor, despite prohibition in the State of Bihar.
Considering the above, I am not inclined to grant
Patna High Court Cr.Misc. No.36685 of 2016 (2) dt.01-09-2016 2/2 the petitioner privilege of anticipatory bail. This application is accordingly rejected.
The petitioner, Chitranjan Kumar @ Dharmpal Kumar, is directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
