Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case for the offence registered under Section 395 of the I.P.C.

The prosecution story, in brief, is that five unknown criminals entered in the office of L.I.C., Shahpur Patory Branch and on the fear of pistol, looted Rs. 10,71,803/-.

Patna High Court CR. MISC. No.27190 of 2020(4) dt.05-01-2021 2/3 It has been submitted by learned counsel for the petitioner that the petitioner is in custody since 02.03.2020. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is not named in the F.I.R. The name of the petitioner has transpired in the present case on the basis of confessional statement of co-accused. It has further been submitted that the petitioner has been identified in the C.C.T.V. footage showing that he was standing in queue in the L.I.C. Office. A supplementary affidavit has been filed on behalf of the petitioner stating therein that the petitioner had gone to L.I.C. Office in connection with a L.I.

C. Policy of his father. Hence, his presence is said to have been marked in the office of the L.I.C. Other co-accused has been granted bail by another Coordinate Bench of this Court vide Cr. Misc. No. 19174 of 2020 under order dated 09.07.2020, annexed as Annexure-2 to the bail application.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is not named in the F.I.R. Considering the aforesaid facts and circumstances of the case, the petitioner above named, is directed to be released
