JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-10-2020 Heard learned counsel for petitioners and learned A.P.P. for the State through video conferencing. The petitioners apprehend their arrest in Bachchwara P.S. Case No.06 of 2020 registered for the offence under Section 307 & other allied sections of the Indian Penal Code
Patna High Court CR. MISC. No.27198 of 2020(2) dt.21-10-2020 2/3 and Section 27 of the Arms Act.
As per the prosecution case, on 04-01-2020, Ramdeo Yadav (petitioner no. 1) stopped father of the informant for rangdari and tried to snatch Rs. 30,000/- (thirty thousand) from him. It is further alleged that when the informant intervened petitioners and other co-accused, who were armed with deadly weapons, co-accused Ram Adhikari Yadav shot three round of firing, out of which, one hit left thigh of informant. It is further alleged that in the occurrence, informant's father and brother were also assaulted.
It is submitted on behalf of petitioners that specific allegation of firing is against co-accused Ram Adhikari Yadav. So far as these petitioners are concerned, no specific over act has been alleged against them. There is general and omnibus allegation. Petitioners are own agnate and due to land dispute between the parties, they have been falsely implicated. The injury report is not available on record. It is stated in paragraph - 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts and circumstances, the bail application of petitioners is allowed. In the event of their arrest or surrender within a period of eight weeks from the date receipt/production of copy of this order, let the above-named

No.27198 of 2020(2) dt.21-10-2020 3/3 petitioners be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Bachchwara P.S. Case No. 6 of 2020, subject to condition as laid down under Section 438(2) of the Cr.P.C.
