JUSTICE ASHUTOSH KUMAR ORAL ORDER 20-01-2022 Heard Mr. Anshuman Singh, learned Advocate for the petitioners and Mr. Vinay Krishna, learned Advocate for the Informant. The State is represented by Mr. Anand Kishore Choudhary, learned Additional Public Prosecutor for the State. The petitioners who are the parents-in-law, brother-inlaw and sister-in-law respectively of the informant, seek bail in anticipation of their arrest in connection with Pipra Kothi P. S. Case No. 27 of 2021 instituted for the offences under Sections 341, 323, 498A and 504/34 of the Indian Penal Code and

It has been submitted on behalf of the petitioners that the accusation against them, apart from being general and omnibus, is absolutely false. The husband of the informant had earlier filed a case of divorce and only after receiving notice in the aforesaid case, the subject F.I.R. has been lodged. It has also been brought to the notice of the court that a maintenance case at the instance of the informant is pending consideration before a competent court.

The learned counsel for the informant however has submitted that his client is desirous of resumption of matrimonial life with her husband.

Considering the afore-noted facts, the petitioners are directed to be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Pipra Kothi P.S. Case No. 27 of 2021, subject to the condition as laid down under Section 438 (2) Cr. P.C.
