Learned counsel for the petitioners submits that during pendency of this application, the petitioner no.2 has been arrested and, as such, this application, as against the petitioner no.2, has become infructuous.
So far petitioner nos. 1 & 3 are concerned, learned Sessions Judge, Rohtas, vide order dated 28.6.2017, had granted anticipatory bail directing the petitioner to surrender and obtain bail within 15 days but, the petitioners could not surrender and furnish bail bonds within the stipulated period of 15 days and filed an application for extension of time which was allowed
Patna High Court Cr.Misc. No.21859 of 2018(3) dt.04-06-2018 2/2 vide order dated 22.9.2017, granting 15 days further time to surrender and furnish bail bonds but, subject to payment of Rs. 500/-. Even thereafter, the petitioners could not surrender before the court below and again filed an application for extension of period but, the same was refused vide order dated 14.12.2017 passed by the learned Additional District and Sessions Judge-IV, Rohtas at Sasaram.
Learned counsel for the petitioners submits that the petitioners could not take proper steps for securing bail and for that they have made a prayer for time.
Looking to the entire facts and circumstances of the case, the order dated 14.12.2017 is set aside and the petitioners are granted further three weeks time to surrender before the court below and obtain bail.
This application is, accordingly, disposed of. (Shivaji Pandey, J) rishi/- U T
