JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-03-2023 Though the present writ petition has been filed for quashing the order dated 27.11.2014, passed by the State Information Commissioner in Case No.82806 of 2012-13, however, the learned counsel for the petitioner has submitted that considering the fact that the said order has been passed in absence of any clarification, required to be submitted by the petitioner, the said order dated 27.11.2014 be directed not to be construed as an adverse remark towards the service career of the
Patna High Court CWJC No.18915 of 2015(2) dt.28-03-2023 2/2 petitioner, moreso, in view of the fact that the petitioner had not been able to furnish the requisite information for reasonable cause, inasmuch as he had been given additional charge of the post of Block Supply Officer, Chehrakala, District Vaishali with effect from 09.08.2014, hence, he was not having any knowledge about pendency of any case under the Right to Information Act, 2005 Having regard to the facts and circumstances of the case, this Court holds that the aforesaid order dated 27.11.2014, passed by the State Information Commissioner, shall not be construed to be having any adverse effect on the service career of the petitioner.
The writ petition stands disposed off on the aforesaid terms.
