The petitioner is apprehending his arrest in connection with Mufassil P.S.Case No. 95 of 2017 registered for the offence under Sections 147, 148, 149, 323, 307, 120B of the Indian Penal Code and 25(1-B)(a), 27 & 35 of the Arms Act. Allegation against the petitioner as per FIR is that on his order other co-accused has fired causing injuries to the injured. Submission of learned counsel for the petitioner is that according to FIR he is order-giver and other co-accused has been given privilege of anticipatory bail by the court of sessions also. Heard learned APP also.

Having heard both sides and in view of the facts and circumstances, let petitioner, above named, surrender within a

No.36637 of 2017 (2) dt.11-08-2017 2/2 period of four weeks before the court below and on his so surrendering he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Munger, in connection with Mufassil P.S.Case No. 95 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition is that one of the bailors should be a local person having sufficient properties within the jurisdiction of court concerned and he will co-operate in investigation of the case and make himself available before the investigating officer as and when required, failing which his bail bond shall be cancelled.
