The petitioners are apprehending their arrest in a case registered for the offence punishable under Section 366A/34 of the Indian Penal Code.
Puja Kumari, aged about 16 years, was missing from her house since 10.03.2016. On search the informant came to know that co-accused Srikant Rai @ Bitoli son of the petitioner Ram Chandra Ray and brother of petitioner Birogi Rai had kidnapped her with intention to marry. When the informant complained to the petitioners, they abused.
Submission of the petitioners is that the matter appears to be of love-affairs, the available case-diary does not
Patna High Court Cr.Misc. No.50579 of 2016 (3) dt.19-12-2016 2/2 show that any substantial material was collected against the petitioners.
Learned Additional Public Prosecutor submits that the victim is still traceless and co-accused Srikant Rai is also absconding.
Considering the nature of allegation, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Vaishali at Hajipur/Successor Court in connection with Mahnar Police Station Case No.44 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
