This application, for grant of anticipatory bail, arises out of Kadwa P.S. Case No. 27 of 2017 disclosing offences under Sections 365, 364/34 of the Indian Penal Code. The petitioner is not named in the F.I.R.. During course of investigation, names of other persons have cropped up including the petitioner's father.
Learned counsel appearing on behalf of the petitioner has submitted that, petitioner's implication is only on the basis of suspicion and the persons, against whom certain materials have been collected, have been allowed regular bail by this Court vide order dated 21.06.2017 passed in Criminal Miscellaneous No.
Patna High Court Cr.Misc. No.47727 of 2017 (4) dt.04-01-2018 2/2 20966 of 2017 and order dated 14.07.2017 passed in Criminal Miscellaneous No. 29955 of 2017.
From the case diary, it appears that those persons against whom incriminating materials have been collected have been granted regular bail by this Court. In this view of the matter, this application is also allowed.
Let the petitioner, above named, in the event of his arrest of surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Katihar in connection with Kadwa P.S. Case No. 27 of 2017 (G.R. No. 414 of 2017) subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
