The petitioner seeks bail in Madhubani Town P.S. Case No. 54/2019, instituted for offences under Section(s) 272 and 273 of the Indian Penal Code read with Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner has submitted that from the seizure-list it appears that recovery has been made from near Raj Guest House.

It is alleged in the written report that police got information that petitioner is indulged in selling of illicit liquor. Seeing the police party petitioner tried to run away but he was apprehended by the police officials. The police recovered huge

Patna High Court CR. MISC. No.24410 of 2019(2) dt.16-04-2019 2/2 quantity of wine from the premises of guest house. Learned counsel for the petitioner has submitted that there is no recovery of any incriminating article from possession of this petitioner.

Petitioner is in custody since 08.02.2019 having clean antecedent.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge-cum-Special Judge, Excise Act, Madhubani, in connection with Madhubani Town P.S. Case No. 54/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner.
