The petitioner seeks bail in Rajoun P.S. Case No. 117 of 2021 corresponding to Special Excise Case No. 260 of 2021, registered for the offence punishable punishable under Section 30(a), 32(2) of the Bihar Prohibition and Excise Act, 2016. 8 litres of country liquor has been recovered from house of this petitioner.

It is submitted that no recovery has been made from conscious possession of this petitioner. The house in question is in joint possession of the family. Petitioner is in custody since 30.03.2021. Investigation is complete.

Considering the period of custody coupled with quantity of recovery, the petitioner above-named, is directed to

No.35961 of 2021(2) dt.09-12-2021 2/2 be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II, Banka in connection with Rajoun P.S.
