JUSTICE ARVIND SRIVASTAVA ORAL ORDER 16-10-2017 In view of order dated 21.09.2017, the application of petitioner nos. 1 and 6 have already been dismissed as infructuous, since during the pendency of this application, they have been arrested.

Heard learned counsel for the petitioner nos. 2,3,4 and 5 and learned A.P.P. for the State.

The petitioners are apprehending their arrest in a case registered under Sections 341, 323,307,379,504, 34 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that there is a case and counter case between the parties. It is further

Patna High Court Cr.Misc. No.42634 of 2017 (3) dt.16-10-2017 2/2 submitted that in the alleged occurrence, both sides sustained injuries. The petitioners have no criminal antecedent and the occurrence took place due to land dispute.

Considering the aforesaid facts and circumstances of the case, let the above named petitioners, in the event of their arrest/surrender in the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/( ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Agrer) P.S.Case No. 577 of 2017,subject to the conditions as laid down u/s 438(2) Cr.P.C.
