The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 326, 354, 379, 504 and 506 of the Indian Penal Code. The petitioner along with other accused persons is said to have assaulted the cousin of the informant, namely, Amit Kumar and Rahul Kumar.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case because in his Nanihal there was marriage ceremony and he requested both parties not to quarrel at the time of function. The allegation levelled against the petitioner is not specific

Patna High Court CR. MISC. No.29838 of 2023(2) dt.13-07-2023 2/2 rather general and omnibus in nature. He submits that the injury was found simple in nature, a true copy of the injury report is enclosed as Annexures-2 and 3 to the bail application. Petitioner has one criminal antecedent as mentioned in para-3 of this application.

Learned APP for the State opposes prayer for anticipatory bail.

Considering the facts and circumstances of the case, nature of the injury and there is no allegation of firing against the petitioner, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Buniyadganj P.S. Case No. 115 of 2022, subject to the as laid down under Section 438 (2) of the Cr.P.C.
