The petitioners are apprehending arrest in a case registered for the offences punishable under sections 420, 406, 467, 468, 471, 120B of the Indian Penal Code. The prosecution case is that all the accused persons including the petitioners came to the house of the informant and introduced themselves as a representative of Sun Mark insurance Company and agent of Indian Life Insurance Company and, hence, they persuaded the investors for investment. Consequently, Rs.2,25,000/- was deposited by the various investors but subsequently it was found that neither the money of the investors has been deposited nor the same was

Patna High Court Cr.Misc. No.55719 of 2015 (2) dt.17-12-2015 2/2 returned.

It is submitted by learned counsel for the petitioners that petitioners were themselves one of the investors and moreover, the informant has retracted from initial version and has filed a petition to that effect before the learned court below, the same has been brought on record as annexure-2 series to the petition. It is further submitted that similarly situated co-accused has been granted anticipatory bail vide Criminal Miscellaneous No.52673 of 2015.

The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Minapur P.S. Case No.190/2015, pending before the learned CJM, Muzaffarpur.

With the above observation, this application is, accordingly, disposed off.
