The petitioner prays for anticipatory bail in connection with Complaint case no. 353 of 2013 registered for the offence punishable under Section 302/34 of the Indian Penal Code.

It has been submitted on behalf of petitioner that petitioner is not named in the F.I.R. and final form has been submitted and on the protest petition, cognizance has been taken against the petitioner and others. It is further submitted that no overt act has been committed by the petitioner. Heard learned A.P.P.

Patna High Court Cr.Misc. No.45547 of 2016 (2) dt.16-12-2016 2/2 Considering the facts and circumstances of the case, submissions advanced, let the abovenamed petitioner, in the event of his arrest or surrender before the Court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Sadar, Sitamarhi in connection with complaint case no. 353 of 2013 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with a condition to the petitioner that he must cooperate in the enquiry as well as trial of the case.
