JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-04-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(i-a)b, 26 and 35 of the Arms Act.

One country made loaded pistol, one live cartridge and one mobile are said to have been recovered from conscious possession of the petitioner for which petitioner is in jail custody since 15.02.2017.

No doubt, petitioner does have criminal antecedent of near about four cases but considering the aforesaid facts and circumstances and period of detention of the petitioner in jail custody as well as this aspect of the matter that in all the above

Patna High Court CR. MISC. No.24647 of 2019(2) dt.18-04-2019 2/2 stated four cases, petitioner has already been granted privilege of bail as per submission of learned counsel of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari in connection with Sugauli P. S. Case No. 21 of 2017.
