JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Maniyari P.S. Case No. 76 of 2015 registered under Sections 272 and 273 of the Indian Penal Code and Sections 47(A) and 47(F) of the Excise Act, pending in the court of J.M. Ist Class, Muzaffarpur.

The accusation is that in course of search of the house of the petitioner, 234 pouches, each containing 200 ml, country made liquor was recovered.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to ulterior motive.

Patna High Court Cr.Misc. No.53169 of 2016 (3) dt.16-12-2016 Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the Court below within four weeks and prayer for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
