In this case, the petitioner is apprehending his arrest in connection with Bakhtiyarpur P.S. Case No. 22 of 2017 registered for offences under sections 406, 409 of the Indian Penal Code.

As per allegation, the money was given to the petitioner for construction of house under the Indra Awas Yojna but, instead of making construction, the petitioner consumed the same for his personal work.

Learned counsel for the petitioner submits that the petitioner has already constructed the house up to the plinth level which is apparently clear from the letter dated 17.12.2017 and further submits that the entire construction of the house has

In view of the statement made at Bar, let the petitioner, namely, Safejul Rai, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Bakhtiyarpur P.S. Case No. 22 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
