JUSTICE PARTHA SARTHY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 23-11-2022 Petitioner has prayed for the following relief(s):- ● "That this is an application on behalf of the petitioner for issuance of a writ in the nature of mandamus or any other appropriate Writ(s), Order (s), Direction(s) to direct the Respondent authority to forthwith take all necessary immediate steps to carry out the construction of motorable Pucca road in Vrindavan Colony and other residential areas off

● To issue a writ in the nature of mandamus or any other appropriate Writ(s), Order(s), Direction(s) to direct the Respondent Authority to relocate the electricity poles which have been installed in the middle of the road which makes it difficult to ply four-wheelers on the road.

● To issue a writ in the nature of mandamus or any other appropriate Writ(s), Order(s), Direction(s) to order the Respondent Authority to take essential steps to remove encroachment while the construction of the road so as to segregate the public land from private land.

● To issue a writ in the nature of mandamus or any other appropriate Writ(s), Order(s), Direction(s) to order the Respondent Authority to not only construct the said road but also to regularly monitor and supervise the maintenance of road so as to ensure that it remains in a motorable condition.

● To issue a writ in the nature of mandamus or any other appropriate Writ(s), Order(s), Direction(s) to order the Respondent Authority to state reasons as to why despite the fact that nearly 50,000 people reside in the said area and the road in the area has not been constructed even once till now."

Ms. Mayuri states that in view of CWJC No. 20252 of 2021, titled as Dr. Ashish Kumar Sinha vs. The Union of India & Ors., petitioner be permitted to withdraw the present petition reserving liberty to raise all issues in the said petition.

Patna High Court CWJC No.7254 of 2020(25) dt.23-11-2022 3/3 Liberty, as prayed for, is granted.

The petition stands disposed of as withdrawn. Interlocutory application, if any, shall also stand disposed of.
