Mr. Chandra Bhushan Prasad , APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-06-2024 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 147, 148 , 149, 447, 324, 307, 384, 504 and 506 of the Indian Penal Code .

3. As per the prosecution case, all the accused persons including these petitioners armed with gun, rifle and pistol started abusing the informant. It is further alleged that on the order of petitioner No. 1 , all the accused persons including petitioner Nos. 2, 3 and 4 fired as a result of which three persons

Patna High Court CR. MISC. No.32398 of 2024(3) dt.25-06-2024 2/2 of the prosecution party sustained gunshot injury.

4. Considering the accusation that petitioner Nos. 2, 3 and 4 made indiscriminate firing and as a result of which three persons sustained gunshot injury , prayer for pre-arrest bail of petitioner Nos. 2, 3 and 4 is rejected.

5 . Considering the fact that petitioner No. 1 is only alleged to be order giver and other circumstances of the case , in the event of arrest or surrender within six weeks from today, let the petitioners No. 1, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate , Vaishali District Court at Hajipur in connection Hajipur Sadar P.S. Case No. 813 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
