JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 09-01-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State as also the learned counsel for the informant. The petitioners apprehend their arrest in connection with Bhawanipur P.S. Case No.116 of 2016 registered under Sections 363 and 366(A)/34 of the Indian Penal Code.
The accusation is of kidnapping the daughter of the informant by one Mukesh Sah, who used to study with the daughter of the informant, with the help of the petitioners. Learned counsel appearing on behalf of the petitioners submits that it would appear from the F.I.R. that both the petitioners are brother and sister in relation and have falsely been
Patna High Court Cr.Misc. No.47111 of 2016 (3) dt.09-01-2017 2/2 implicated in this case due to grudge as the house of the petitioners is situated adjacent to the house of the informant. The informant has only stated that the victim was seen with the petitioner no.2. In fact, there was love affair in between the daughter of the informant and Mukesh Sah and both left the house at their own sweet will.
Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri L.B. Paswan, Judicial Magistrate, First Class, Purnia, in connection with Bhawanipur P.S. Case No.116 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
