Mr. Umeshnand Pandit, APP 187 ====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 20-04-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in connection with Piyar P.S. Case No. 12 of 2017 for offences punishable under Sections 406, 420, 467 and 471 of the Indian Penal Code. The prosecution case, as per the written report, dated 13.02.2017, of the Block Education Officer, Bandra, Muzaffarpur, submitted to the Station House Officer, Piar Police Station, Bandra, Muzaffarpur, is to the effect that 61 persons, including the petitioner, got appointed as Panchayat Teacher on the basis of the forged teacher's eligibility test result.

It is submitted by the learned counsel for the petitioner that the alleged certificate of the petitioner was issued by the Bihar School Examination Board, Patna. More over, the service of the petitioner has been terminated, which gets reflected from the impugned order. It is submitted that the similarly situated persons have been granted anticipatory bail by a coordinate Bench of this Court vide

Patna High Court Cr.Misc. No.20468 of 2018(2) dt.20-04-2018 2/2 order, dated 02.02.2018, passed in Cr. Misc. No. 6039 of 2018 and order, dated 01.09.2017, passed in Cr. Misc. No. 40091 of 2017. The learned Additional Public Prosecutor submitted that the petitioner's service has been terminated on the basis of forged certificate.

Considering the facts that the service of the petitioner has been terminated and the similarly situated persons have been granted anticipatory bail by a coordinate Bench of this Court of this Court, the prayer of the petitioner for grant of anticipatory bail is allowed, in the event of surrender/arrest of the petitioner, named above, before the Court below, within six weeks from today in connection with Piar P.S. Case No. 12 of 2017. He shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, V, Muzaffarpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
