The instant application is renewed by the petitioner for regular bail which has been filed in connection with Korha P.S. Case No. 177 of 2021 instituted for the offence u/s 361, 363, 367, 368, 370, 370(A)/34 of the Indian Penal Code.

Earlier the application for regular bail of the petitioner was rejected by order dated 04.12.2023 passed in Cr. Misc. No. 40576 of 2023 with an observation to learned trial court to expedite the trial and conclude the same as soon as possible.

No.29454 of 2024(3) dt.21-06-2024 2/3 As per allegation in the F.I.R., the petitioner along with other co-accused persons are said to have been involved in the trade of victims in the name of providing work as laborers. 7-8 months before the occurrence, the petitioner has contacted the victims and induced them for lucrative remuneration and sent them to Uttar Pradesh and other places.

Learned counsel for the petitioner submits that similarly situated co-accused Nishu Rishi has been allowed bail by learned trial Court. Moreover, petitioner is languishing in judicial custody since 31.03.2023.

From perusal of the trial court report (kept at flag S), it appears that the case is pending for evidence. There are 18 charge-sheeted witnesses, out of them only two witnesses have been examined till date. There is no hope to conclude the trial in near future. Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of bail.

No.29454 of 2024(3) dt.21-06-2024 3/3 Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, enlargement of bail to similarly situated co-accused Nishu Rishi as well as period of custody of the petitioner, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Korha P.S. Case No. 177 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge I-cum-Special Judge, SC/ST, Katihar.
