JUSTICE ARUN KUMAR ORAL ORDER 21-08-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 147, 148, 149, 341, 323, 504, 506, 342, 332, 353, 336, 290, 186, 187, 189, 427 of the Indian Penal Code and 27 of the Arms Act.

Allegation in brief is that a large number of local people including the petitioner were protesting and blocked the road as a person was hit by fire brigade and injury was caused to him. The police reached there then the mob started pelting stones and some of the accused opened fire.

Submission is that there is no allegation of opening fire against the petitioner he is said to be member of the mob whereas the accused person Chandan Singh having specific

Patna High Court Cr.Misc. No.39030 of 2017 (2) dt.21-08-2017 2/2 allegation of opening fire and other two co-accused Kamlesh Yadav and Bhuanwar Chaudhary have been granted anticipatory bail by a Co-ordinate Bench of this Court by Cr. Misc. Nos.24069 of 2017 and 27597 of 2017 respectively.

Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Sarvjeet Yadav @ Sujit Kumar Yadav be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Itarhi P.S. Case No.63 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
