JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-07-2019 This is an application for grant of anticipatory bail in connection with Nadi P.S. Case No. 184 of 2018, disclosing offences under Sections 341, 323, 324, 307, 504, 34 of the Indian Penal Code.

Prosecution story as per written report filed by the informant is that the accused persons came variously armed attacked his house and assaulted the brother of the informant namely, Pawan Kumar, causing injury and they have also

It is also stated that the accused persons thereafter, assaulted his father and some other persons assaulted his wife, causing serious injury. The reason behind the occurrence as per the written report is that one Dalip Sao, who is brother-in-law of one Ramjanam Sao was abusing the informant family after taking liquor, which was informed by the informant to the police and police arrested Dilip Sao and sent to jail, for that the present occurrence took place. Submission of the learned counsel for the petitioners is that the whole allegation is false and concocted and the injuries are simple in nature, which will appear from the case diary.

Heard learned A.P.P. also, who has also not controverted that the injuries are simple in nature. Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of Shri Gopal Krishna Judidial Magistrate 1st Class, Patna City, in connection with Nadi P.S.
