This application, for grant of anticipatory bail, arises out of Sikty Police Station Case No. 183 of 2018, disclosing offences under Sections 341/323/504/506/498-A/34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act, 1961.
The allegation against the petitioner, as per the First Information Report, is that the petitioner tortured his wifeOpposite Party No. 2, mentally and physically, for demand of dowry.
The matter was referred to Patna High Court Mediation and Reconciliation Centre and the report of the
Patna High Court CR. MISC. No.25101 of 2019(5) dt.04-09-2019 2/2 learned Mediator, dated 28.08.2019, is on record and from perusal of the same, it appears that by a joint agreement, dated 26.08.2019, both the parties have amicably settled their disputes and are living together as husband and wife.
In view of the above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Araria, in connection with Sikty Police Station Case No. 183 of 2018, subject to the conditions (i) laid down under Section 438 (2) of the Code of Criminal Procedure and (ii) the petitioner shall abide by the terms and condition of the agreement, dated 26.08.2019, entered into the parties before the learned Mediator.
