Prayer is for grant of anticipatory bail in Madhepura P.S. Case No. 332 of 2006 registered under sections 420 and 504 IPC.
Initially, a complaint was lodged in 2006. The police submitted the final form. The learned court below, differing with the report, took cognizance in 2016. Hence the apprehension. After placing the FIR, it has been submitted that no case under section 420 IPC is made out. In the impugned order of the learned Sessions Judge nothing has been stated save and except that the learned Magistrate took cognizance differing with the report. It is stated that the petitioner has a clean antecedents. Let the petitioner above named, in the event of
Patna High Court Cr.Misc. No.3177 of 2018(2) dt.16-01-2018 2/2 arrest/surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M.-III, Madhepura in Madhepura P.S. Case No. 332 of 2006, G.R. No.1219 of 2006 on condition that one of the bailors shall be his own/close family member. As soon as the charges are framed, the petitioner shall appear in person on each date fixed in the court below. In case of default in appearance on two date consecutively, the trial court shall cancel his bail bonds and secure his arrest in accordance with law.
