2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 341, 323, 302, 504/34 of the Indian Penal Code, registered in connection with Chewara P.S. Case No. 92 of 2023.
3. The allegation against the petitioner along with others is of killing the daughter of the informant.
4. The learned counsel for the petitioner has submitted that he has been falsely implicated in this case and has committed no offence. Petitioner is the cousin brother-in-law (Bhaisur) of the informant and has no share in the land property of the informant or her agnates. There is no specific allegation
Patna High Court CR. MISC. No.29013 of 2024(3) dt.13-08-2024 2/2 against the petitioner rather the own agnates of the informant namely, Sanjeev Kumar @ Makku and Rambriksha Singh had taken the deceased on the pretext of her treatment and done to death. There is no cogent evidence against the petitioner to show his complicity in the alleged occurrence. Moreover, petitioner is a person of clean antecedent and he is in custody since 06.03.2024.
5. Learned APP for the State has opposed the prayer of bail.
6. Considering the above facts and circumstances of the case as well as petitioner has clean antecedent, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sheikhpura in connection with Chewara P.S. Case No. 92 of 2023, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
