Mr. Chandra Bhushan Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 25-06-2024 Heard learned counsel for the petitioners and learned A.P.P appearing on behalf of the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 302 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case as per F.I.R is that all the F.I.R named accused persons including the petitioners came variously armed and

It is specifically alleged against coaccused Akhilesh Yadav that he assaulted with Garasa on the right leg of the brother of the informant, as a result of which, he fell down and thereafter co-accused Ajay Yadav shot at the brother of the informant, as a result of which, he sustained gunshot injuries and died. It is submitted by learned counsel for the petitioners that petitioners are innocent and they have falsely been implicated in this case. There is long standing dispute between the parties and the deceased was the cousin brother of the husband of petitioner No. 1. The specific allegation of shot fire is against coaccused Ajay Yadav. The petitioners are ladies and they have got no concern with the alleged occurrence. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

In contra, learned A.P.P appearing on

Patna High Court CR. MISC. No.30533 of 2024(3) dt.25-06-2024 3/3 behalf of the State has vehemently opposed the prayer for bail of the petitioners.

Considering the facts aforesaid and the facts that petitioners are ladies and there is no direct allegation against them, let the petitioners, above named, in the event of their arrest or surrender before learned Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge, Hilsa, Nalanda in connection with Hilsa P.S. Case No. 459 of 2022.
