The present application has been filed for modification of the order dated 12.03.2018 passed in Cr.Misc.No. 12959 of 2018, by which the petitioner was granted anticipatory bail in connection with Laukahi P.S. case No.232 of 2017, pending in the court of Additional Sessions Judge II-cum-Special Judge, Excise Act, Madhubani.
It has been submitted on behalf of the petitioner that due to inadvertent mistake, father's name of the petitioner was mentioned in the main application i.e. Cr.Misc.No.12959 of 2018 as 'Late Shivnandan Mandal' in place of 'Sri Amit Mandal' and accordingly mistake has occurred in the cause title
Patna High Court Cr.Misc. No.20326 of 2018(2) dt.12-04-2018 2/2 of the order dated 12.03.2018 passed in Cr.Misc.No.12959 of 2018.
In view of the above, let the father's name of the petitioner be read as 'Sri Amit Mandal' in place of 'Late Shivnandan Mandal'.
The period of surrender of the petitioner in the court below is extended for a further period of six weeks from the date of receipt/production of a copy of this order. The rest of the conditions stipulated in the order well be same. The order dated 12.03.2018 passed in Cr.Misc.No. 12959 of 2018, is modified to the extent as indicated above.
