JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-04-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 353, 354, 504 of the Indian Penal Code and Section 37(c) of Bihar Prohibition and Excise Act.

The accusation against the petitioner is that in inebriated condition he misbehaved with the informant and also obstructed her from discharging her official duty. Submission on behalf of the petitioner is that some dispute took place between the informant as well as petitioner as the informant was not discharging her official duty in accordance with rules and when the petitioner raised objection

Patna High Court CR. MISC. No.24583 of 2019(2) dt.17-04-2019 2/2 against the arbitrariness of the informant, she lodged this false case with the help of local police. He further submits that moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 23.02.2019. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, East Champaran, Motihari in connection with Ramgarhwa P.S. Case No. 34 of 2019.
