In this case, the petitioners are seeking anticipatory bail in connection with Complaint Case No.1107 of 2016, registered for the offence punishable under Sections 420, 323, 341, 504, 506 and 120B of the Indian Penal Code. As per the complaint petition, Priti Kumari and Amit Kumar (dead) and Sudha Devi and Santosh Kumar have entered into an agreement for sale and the land is the ancestral property of Sudha Devi. The agreement was made for sale of 18 Khatas and 10 Dhurs of land. The details of the land has been given in complaint petition. It is alleged that the promissor has

Patna High Court Cr.Misc. No.19150 of 2018(2) dt.06-04-2018 2/2 sold some part of the land to another person. In the complaint petition with regard to execution of the agreement no role has been defined to the petitioners, but allegation has been made that the petitioners have entered into the house of the complainant in the night and assaulted her and took away Rs.21,000/-, save and except there is nothing against the petitioner.

Looking to the facts and circumstances of the case, let the petitioners, namely, Arbind Singh and Pratima Devi, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Patna, in connection with Complaint Case No.1107 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
