Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Akorhi Gola PS case no. 187 of 2024 dated 03.08.2024, disclosing offences punishable under Sections 303(2) of B.N.S. Act.

The prosecution story, as per the First Information Report, is that on 03.08.2024 at about 5.45 pm, the informant went to the market on his motorcycle bearing registration no. BR 24U 4437. He parked the motorcycle and when he returned, he could not find his motorcycle. The informant has apprehension that his motorcycle was stolen by unknown thieves.

Learned Counsel for the petitioner submits that

No.25615 of 2025(2) dt.07-05-2025 2/2 petitioner has falsely been implicated in this case on the basis of confessional statement of accused Krishna Kumar in Akorhi Gola PS Case No. 252 of 2025. Learned counsel further submits that petitioner has not been arrested from the spot and no any incriminating article has been recovered from his conscious possession. He also submits that though the petitioner is accused in one more case but he is on bail in the said case. 5.

Having regard to the submissions made on behalf of the parties and taking into consideration the confessional statement of accused Krishna Kumar, brother-in-law of the petitioner, in Akorhi Gola PS Case No. 252 of 2025 that he along with the petitioner have actively participated in the theft of the motorcycle and the confessional statement may be basis of further investigation, for which custodial interrogation of the petitioner may be necessary, I am not inclined to grant the privilege of anticipatory bail to the petitioner. 6.

This application is, accordingly, rejected.
