This is a petition for grant of anticipatory bail for offence under Sections 363, 366A and 34 of the Indian Penal Code.

The petitioner is alleged to have kidnapped Nazni Khatoon, aged about 15 years. The victim girl in her statement under Section 164 of the Criminal Procedure Code stated that she had love affairs with the petitioner and she wants to be with the petitioner.

Submission is that in fact victim has been released to go with the petitioner.

Considering the statement of the victim girl, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Jandaha P.S. Case No. 34 of 2016 to the satisfaction of Sri Prabhat Kumar, Additional Chief Judicial Magistrate, XI, Vaishali at Hajipur, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
