JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 20-09-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Gopalpur (Ismilepur) P.S. Case No. 146 of 1994 registered under Sections 147, 148, 149, 323, 342, 384 of the Indian Penal Code and Section 27 of the Arms Act.

Regard being had to the specific allegation made in the FIR against several persons including the petitioner to have demanded extortion on the point of pistol, I am not inclined to grant pre-arrest bail to the petitioner. Accordingly, the prayer for

Patna High Court Cr.Misc. No.41652 of 2017 (2) dt.20-09-2017 grant of pre-arrest bail is rejected.

In case the petitioner surrenders and seeks bail, the same shall be considered on its own merit without being prejudiced in any manner by this order.
