The instant application has been filed for restoration of Second Appeal no.512 of 1989 which stood dismissed in default by order dated 29.1.2020.

It is submitted by learned counsel for the petitioner that the erstwhile learned counsel, appearing for the appellant in Second Appeal no.512 of 1989, passed away during pendency of the instant appeal and as such, no one appeared when the case was called out.

Having heard learned counsel for the parties and taking into consideration the contents of the restoration application, the Court is satisfied that the appellant is made out a

Patna High Court MJC No.1281 of 2021(5) dt.14-12-2022 2/2 case for restoration of the appeal.
