Mr. SRI CHANDRASEN PRASAD SINGH ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-02-2018 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

This is an application for grant of anticipatory bail in connection with Narpatganj P.S. Case No. 513 of 2017 registered for the offence punishable under Section 7 of the E.C. Act.

The allegation is regarding recovery of certain number of bags of wheat and rice from a pick up van, which is stated to be that of one co-accused person, however, the petitioner is the person, who had possessed the said bags of wheat and rice and was carrying them to his village.

The learned counsel for the petitioner submits that the Mukhiya has falsely alleged that the petitioner herein had disclosed that he was carrying the said wheat and rice for the

Patna High Court Cr.Misc. No.9818 of 2018(2) dt.19-02-2018 2/2 purposes of black marketing whereas the fact is that it was for his bona fide use. The petitioner is stated to having a clean antecedent.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Araria in connection with Narpatganj P.S. Case No. 513 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
